Representatives Lloyd Doggett (D-TX), Greg Murphy (R-NC), Mark Takano (D-CA), David Schweikert (R-AZ), John Joyce (R-PA) and Senators Elizabeth Warren (D-MA), Bill Cassidy (R-LA), and Richard Blumenthal (D-CT) on June 23, 2025 introduced the Guarantee Utilization of All Reimbursements for Delivery of (GUARD) Veterans’ Health Care Act.
The legislation will permit the Veterans Health Administration (VHA) to recoup health care costs for dually enrolled veterans in private insurance Medicare Advantage (MA) and Medicare Prescription Drug (Part D) plans thereby removing a longstanding statutory loophole that results in taxpayers paying twice for veterans’ health care.
This loophole was identified in a report by researchers in October 2024 that identified $78 billion in federal overpayments to plans for veterans’ health care.
