Late on February 2, 2026, a federal judge temporarily halted the administration’s plan to end Temporary Protected Status (TPS) for Haitians, just one day before protections were set to expire. Critically, for Haitian TPS holders and for LeadingAge members, the ruling allows some 330,000 Haitian TPS holders to continue living and working legally in the U.S. while litigation proceeds.

The district court found that the Trump administration’s decision appeared improperly motivated and not grounded in an assessment of conditions in Haiti, which remains destabilized by gang violence and political turmoil. The Department of Homeland Security (DHS) will very likely appeal. Based on statements from DHS leadership on social media, we anticipate the government will appeal directly to the Supreme Court.
