Reversing a July 31, 2025 ruling by a federal district court, the Ninth Circuit Court of Appeals on August 20, 2025 cleared the way for the U.S. Department of Homeland Security (DHS) to proceed with ending Temporary Protected Status (TPS) for over 63,000 immigrants from Nicaragua, Honduras, and Nepal.
The July 31 federal district court ruling had temporarily postponed the expiration of TPS protections through at least November 18, 2025.
With the August 20 ruling, DHS may now enforce the original expiration dates for the three countries: Nepal’s designation expired August 5, 2025, and Honduras’ and Nicaragua’s designations will expire September 8, 2025.
The appellate court decision has implications for long-term care providers, particularly those employing TPS holders from these countries, some of whom have lived and worked legally in the U.S. for over two decades. While some individuals may have pending asylum or other legal claims, many could face loss of status and work authorization as a result of these TPS designations ending.
