The Department of Housing and Urban Development (HUD) in a March 13, 2026 rule posted on the Federal Register adjusted the timeline for revoking a requirement that housing providers participating in certain HUD affordable housing programs give 30-days of notice to tenants facing eviction for nonpayment of rent.
HUD in late February announced plans to implement the revocation at the end of March while simultaneously accepting public input (known as an interim final rule)–a move viewed as controversial by many.
HUD has switched to a proposed rule structure, meaning that the agency will review all public comments before moving forward with the new rule.
Revoking the eviction notification requirement will revert HUD programs to a patchwork of federal, state, and local notification timelines, including some that are as short as a few days.
LeadingAge previously supported clear notification requirements as a pathway for reducing confusion and inconsistency and preventing evictions for older adults with low incomes.
