Centers for Medicare & Medicaid Services (CMS) reviewed the current process to promote compliance with the Settings Rule, including the Statewide Transition Plans and applications for Corrective Action Plans processes. CMS noted a few trends of non-compliance from site visits completed: access to visitors, community integration, staff training on home and community based services (HCBS), and lease/residency agreements.
Extensive time and descriptions were offered on the slides relating to lease and residency agreements. Egregious examples were shared citing providers found to be non-compliant with the provisions of staff training and community integration; these providers appeared unaware the settings rule existed.
The sentiment on the webinar was of collaboration, though we know some states have taken a different approach. Georgia Goodman continues to collect stories from providers of why the settings rule doesn’t make sense for aging services providers.
