The Department of Housing and Urban Development (HUD) Office of Multifamily Housing (MFH) programs published reminders of legal requirements for properties owners screening tenants on May 19. According to HUD, property owners increasingly rely on tenant screening reports as part of their selection criteria, but research shows that these reports often include inaccurate information. As a result, renters may be repeatedly and unfairly denied housing.
HUD’s outreach reminds HUD-assisted MFH providers of legal requirements related to admissions screening and shares best practices around the use of tenant screening reports and disclosure to tenants. View LeadingAge’s resource on HUD and FCRA requirements for admissions denials here.
HUD is expected to release additional information about changes to tenant screening requirements for criminal background checks in summer of 2023.
