The Department of Housing and Urban Development (HUD) is seeking public comment on activities related to the effectiveness of certain homelessness interventions funded through the agency’s Continuum of Care (CoC) program.

The notice, published September 11, 2026, in the Federal Register, follows a U.S. District Court of Rhode Island’s recent court order, which found that HUD had violated the Administrative Procedures Act (APA) when the agency failed to properly engage the public during an attempt to overhaul longstanding approaches to homelessness interventions through the CoC program.

While the court vacated HUD’s attempt at overhauling the 2026 funding opportunity for CoCs, the court stopped short of permanently halting HUD’s efforts, instead calling out where HUD had failed to follow required procedure related to public engagement.

LeadingAge supports the opportunity for public comment, which is open until October 11, and asks for feedback on activities that are “proven to be effective at reducing homelessness or preventing homelessness” so that HUD can then incentivize through its CoC funding opportunities.

In late 2025, HUD attempted to shift the majority of funding previously allotted to Permanent Supportive Housing (PSH), a proven solution to address homelessness, to short-term transitional housing instead, jeopardizing housing for about 170,000 people housing in a PSH unit. The move was challenged in court, and HUD temporarily withdrew the overhaul attempt while the litigation continues.

The fastest growing demographic of homeless people in the country today are those 55 and older; according to the latest HUD data available, nearly 40% of PSH residents in 2023 were older adults. LeadingAge continues to urge HUD to commit to PSH and similar effective homelessness interventions.
