 Is your community testing for marijuana use?  Is your community allowing non-clinical staff, or clinical staff, to test positive for marijuana use?  Elimination of drug testing requirements, or changes to your existing drug testing policies and hiring practices, should come with a balancing of risk with your community’s staffing needs.

Join us as we discuss current state and federal laws on marijuana testing in the employment setting, and how those laws impact hiring and operations in the long term care setting.

We will also discuss alternative approaches to drug testing policies, and how these modified drug testing policies could increase legal exposure related to both resident care and employee-related liability claims.

Carin A. Marney – Co-Chair of Lane Powell’s Senior Living and Long Term Care team, represents health care and long term care providers in regulatory and litigation matters. She has deep experience advising clients in this highly-regulated industry on compliance and helping them avoid and also resolve disputes, both in and outside of court.

Christine E. Thelen – As a former Human Resources Consultant, Christine brings to her practice a unique understanding of the challenges employers and HR professionals face, from workplace disputes and employee relation issues to compliant policies and practices.
