Senators Mark Warner (D-VA) and Tim Scott (R-SC) reintroduced on April 30, 2026, the Ensuring Seniors’ Access to Quality Care Act, which would fix the certificed nursing assistant (CNA) lockout that automatically bans nursing homes from training certified nurse aides for two years based on a civil money penalty above a certain threshold, even if the fines were unrelated to the quality of care provided to residents, unrelated to the quality of training, and were promptly identified and addressed to minimize impact and prevent recurrence. The bill also allows nursing homes to access the National Practitioner Data Bank (NPDB) to better screen and vet potential employees.
