CMS will be issuing corrected FY2020 Performance Score Reports no later than August 31. SNFs’ performance scores and value-based incentive payment (VBIP) modifiers may differ from the initial report impacting a SNF's Medicare payments beginning October 1, 2019. SNFs do not need to take any additional action once the corrected reports are available in a SNF’s CASPER folder. CMS anticipates that rate adjustments using the corrected VBIP modifier will still take effect as previously scheduled on October 1, 2019.

Nursing homes were in the news this summer when the Centers for Medicare & Medicaid Services issued 2 nursing home-related rules, and the Senate held a hearing on protecting nursing home residents from abuse.
This rule applies prospectively to determine the eligibility of persons wishing to immigrate to the US, obtain a green card to authorize employment or to obtain certain visas. Note that this rule will not be applied to immigrants currently in the country unless or until they seek to change or extend their immigration status.
At the end of July, CMS posted an updated file related to Special Focus Facilities (SFF) on the Nursing Homes page of the CMS website. This document appears to address several of the issues identified in a June 2019 report released by Pennsylvania Senators Bob Casey and Pat Toomey.
LeadingAge recently responded to CMS’s second Request for Information (RFI) on the Patients Over Paperwork initiative. The initiative, first launched in 2017, aims to reduce unnecessary burden, increase efficiency, and improve the beneficiary experience by streamlining regulations and subregulatory guidance. On July 30, CMS announced that it had finalized the SNF PPS rule for FY 2020. This rule was published to the federal register on August 7. LeadingAge submitted comments on the proposed rule and a summary of the final rule, including our comments, follows below.
On July 31, CMS issued a revised Quality, Safety & Oversight (QSO) Group memo announcing that it had, once again, updated Appendix Q of the State Operations Manual. This appendix provides guidance to surveyors on citing immediate jeopardy (IJ) and was most recently updated in March 2019.
