In the Fiscal Year 2025 Skilled Nursing Facilities (SNF) Prospective Payment System (PPS) proposed rule, CMS proposes to expand authority to enforce civil money penalties (CMPs) against nursing homes. The provisions would allow CMS to enforce both per instance and per day CMPs in the same survey, to enforce multiple CMPs for the same or similar types of noncompliance, and to look as far back as the three most recent standard surveys when calculating per day CMPs. These changes would result in more CMPs and higher dollar amounts for nursing homes.
